DEFINITIONS

For purposes of this document, the following definitions apply:

• “Attendee” or “You” means any person entering the Event, including ticket holders, guests, volunteers, and minors accompanied by a parent or guardian.
• “PLV” or “We” means Open Road Social, LLC, a Kentucky limited liability company doing business as “Peace Love & Vans”, including its members, managers, employees, agents, volunteers, and representatives.
• “Event” means any PLV festival, gathering, or activity held in the State of Florida, including the event at Withlacoochee River Park.
• “Property” means the event venue, including all land, facilities, structures, and areas designated for Event use.

PART 1: LIABILITY WAIVER & MEDICAL RELEASE

1.1 Assumption of Risk & Inherent Dangers

Attendee acknowledges and understands that PLV events take place in remote, outdoor environments with inherent and unavoidable risks that cannot be eliminated without changing the fundamental nature of the Event. These environments and activities involve serious risks, including but not limited to:

• Extreme weather conditions including heat, cold, rain, lightning, and high winds
• Natural hazards including fire, flooding, and unstable terrain
• Wildlife encounters including venomous snakes, alligators, bears, and stinging insects
• Uneven ground, steep terrain, rocky surfaces, and trip hazards
• Deep or moving water and submerged obstacles 
• Vehicle traffic, moving vehicles, and parking lot hazards
• Vans, RVs, campers, and other vehicles present throughout camping areas, including risks from moving vehicles in shared spaces, generator operation, exhaust fumes, propane use, electrical connections, and equipment and trip hazards associated with vehicle camping
• Actions or negligence of other attendees, volunteers, and third parties
• Equipment failure, structural failures, and utility failures
• Delayed emergency response (medical facilities may be 30 minutes or more away)
• Exposure to communicable diseases including COVID-19 and other illnesses
• Limited or no artificial lighting throughout most areas of the Property; nighttime conditions create significant trip, fall, and collision hazards, and Attendees are responsible for providing their own lighting at all times after dark
• Domestic animals and pets brought by attendees, volunteers, or third parties, including risks of bites, scratches, knockdowns, allergic reactions, and disease transmission; pets may be unrestrained, unpredictable, or aggressive, and Attendees interact with any animal on the Property at their own risk

ATTENDEE ACKNOWLEDGES THAT THESE RISKS MAY RESULT IN SERIOUS PERSONAL INJURY, PERMANENT DISABILITY, DEATH, AND PROPERTY DAMAGE. ATTENDEE VOLUNTARILY AND KNOWINGLY ASSUMES ALL SUCH RISKS.

1.2 Release and Waiver of Liability

In consideration for being permitted to attend and participate in the Event, Attendee, on behalf of themselves, their heirs, personal representatives, executors, administrators, and assigns, hereby:

1. RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE PLV, its members, managers, employees, agents, volunteers, sponsors, exhibitors, vendors, property owners, and all affiliated entities; any predecessor entity that previously produced the Event, and the current and former members, managers, employees, contractors, volunteers, and agents of any such predecessor; and the successors and assigns of each of the foregoing, from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by Attendee, Attendee’s minor children, or Attendee’s pets, whether caused by the negligence of PLV or any of its representatives, the actions or negligence of other attendees or third parties, the inherent risks of the Event and its environment, or any other cause.
2. INDEMNIFIES AND HOLDS HARMLESS PLV from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, arising out of, or relating to, Attendee’s attendance, conduct, or participation in the Event, including claims arising from Attendee’s own negligence or violation of these Terms.
3. AGREES that this waiver applies to claims based on the negligence of PLV, its representatives, or other attendees, and to both foreseeable and unforeseeable risks.

 

1.3 Gross Negligence and Willful Misconduct

Nothing in these Terms or the standalone PLV Liability Waiver shall release PLV from liability for gross negligence, willful misconduct, or intentional acts. To the maximum extent permitted by applicable law, Attendee acknowledges that all claims arising from the ordinary negligence of PLV are waived and released. This limitation shall be interpreted under the laws of the State of Florida.

1.4 Medical Treatment & First Aid

Volunteer Medical Personnel: On-site medical staff are unpaid volunteers providing basic first aid only. PLV does not operate a licensed medical clinic and does not provide professional medical diagnosis, treatment, or emergency medical services.
Consent to Treatment: Attendee consents to receive basic first aid from volunteer personnel and authorizes PLV to contact emergency medical services (911) on Attendee’s behalf if deemed necessary.
Transport Authorization: Attendee consents to be transported via a non-ambulance extraction vehicle (such as a UTV, 4×4, golf cart, or similar vehicle) for movement within the Property only. Attendee acknowledges this vehicle is NOT a licensed ambulance and assumes all risks associated with transport over rough, uneven terrain.
Financial Responsibility: Attendee is solely responsible for all costs related to professional emergency services, ambulance transport, hospital care, aero-medical evacuation (e.g., Flight-for-Life), and any other medical expenses. Attendee agrees to maintain adequate health insurance.
Emergency Contact: Attendee agrees to provide accurate emergency contact information and authorizes PLV to contact such persons in the event of a medical emergency.

1.5 Specific Florida Environmental Risks

The Florida Event at Withlacoochee River Park is a natural habitat containing specific and significant risks, including but not limited to:

• Deep or moving water in the Withlacoochee River with strong currents and submerged obstacles
• Native wildlife including alligators, venomous snakes (cottonmouths, rattlesnakes), and stinging insects
• Wetland areas with unstable ground and muddy conditions
• High heat and humidity with risk of heat exhaustion and heat stroke
• Severe weather including thunderstorms, lightning, and heavy rainfall
• Poisonous plants including poison ivy and poison oak

Attendee assumes all risk of injury or death associated with proximity to the Withlacoochee River, surrounding wetlands, and wildlife.

1.6 Communicable Disease Risk

Attendee acknowledges that an inherent risk of exposure to communicable diseases, including but not limited to COVID-19, influenza, norovirus, and other illnesses, exists in any public gathering. By attending the Event, Attendee voluntarily assumes all risks related to exposure to such diseases and agrees to follow any health and safety protocols implemented by PLV or required by applicable authorities. Attendee agrees that PLV shall not be held liable for any illness, injury, or death resulting from exposure to communicable diseases at the Event.

1.7 Alcohol and Substance Use

Assumption of Risk: Attendee acknowledges the risks associated with alcohol consumption at a multi-day outdoor camping event and agrees to consume alcohol responsibly. Attendee assumes all risks associated with their own alcohol consumption and that of other attendees, including impaired judgment, accidents, injuries, and interactions with other attendees, regardless of the source of such alcohol.

Licensed Alcohol Service: Where alcoholic beverages are offered for sale at an Event, they are served by the holder of the applicable state and local alcohol license or permit for that Event, as identified in Event materials. Where PLV is not the licensed permit holder, PLV does not sell, serve, or furnish alcohol, and bears no liability under any dram shop, liquor liability, or social host statute of any jurisdiction for alcohol served by the permit holder or its personnel. Where PLV or an affiliate holds the applicable license, service is conducted in accordance with applicable law, and Attendee’s assumption of risk under this Section continues to apply. Some Events may offer no alcohol service at all.

BYOB in Campsites: Attendees may bring their own alcoholic beverages for personal consumption in campsite areas where permitted. Attendee assumes all risks arising from their own alcohol consumption and that of other attendees on the event premises, regardless of source. PLV is not responsible for incidents arising from alcohol consumed from personal supplies.

Service Restrictions: Alcohol will not knowingly be served to any person under 21 years of age or to any person who appears intoxicated. Attendee agrees to present valid identification upon request.

1.8 Prohibited Conduct: Attendee agrees not to operate any vehicle, bicycle, UTV, golf cart, or any other equipment while impaired by alcohol or any substance. Attendee is solely responsible for any injury they cause to others while under the influence. Providing alcohol to minors (persons under 21 years of age) is strictly prohibited and will result in immediate ejection from the Event without refund and may result in criminal prosecution.

PLV reserves the right to refuse entry to or eject any person who appears intoxicated or impaired, without refund.

1.9 Code of Conduct

We are committed to creating a safe, respectful, and inclusive environment for all attendees.

The following behaviors are strictly prohibited:

• Harassment, discrimination, or threatening conduct
• Excessive intoxication or disruptive behavior
• Failure to follow staff instructions
• Actions that endanger the safety or enjoyment of others

We reserve the right, in our sole discretion, to refuse entry or remove any attendee from the Event at any time for violation of this Code of Conduct, without refund.

PART 2: EVENT TERMS & CONDITIONS

2.1 Ticketing, Refunds & Cancellation

No Refunds: All ticket sales are final. No refunds or credits will be issued for any reason, including but not limited to: change of plans, personal circumstances, illness, quarantine requirements, weather conditions, schedule changes, removal for conduct violations or, refusal to complete required liability waiver.

Rain or Shine: Events are held rain or shine. Weather-related inconveniences do not constitute grounds for refunds.

Force Majeure: Event cancellation, postponement, or modification due to circumstances beyond our control is governed by Section 2.12.

Chargebacks & Payment Disputes: By purchasing a ticket, you agree not to initiate any chargeback or payment dispute with your bank or credit card provider without first making a good-faith effort to resolve the issue directly with us.

Any chargeback initiated in violation of this agreement may result in:

• Immediate voiding of your ticket without refund
• Denial of entry or removal from the Event
• Ineligibility for future events

You agree that this policy constitutes a binding agreement for purposes of dispute resolution with your financial institution.

Limitation of Liability: The total liability of PLV for any claim related to ticket purchase shall not exceed the ticket price paid.

Transfer and Resale: Tickets are non-transferable without prior written approval from PLV. Unauthorized resale or transfer of tickets is prohibited and may result in ticket cancellation without refund.

Fees: Service fees, processing fees, and similar charges may be added to each ticket and/or order. We display the total price, inclusive of all mandatory fees, before you complete your purchase. Government-imposed taxes, delivery charges, and any optional add-ons you select are shown separately. Fees are non-refundable except as required by law or as otherwise provided in Section 2.12. You are responsible for any mobile carrier charges associated with ticket delivery.

Unlawful Ticket Reselling: We in no way condone the unlawful resale of tickets. Any unlawful attempt to resell tickets purchased through us will result in us terminating those tickets without compensation or liability to you, as well as the customer being barred indefinitely from use of any of our services

2.2 Vehicle & Camping Guidelines

Length Restrictions: Standard camping spots accommodate rigs up to 24 feet in length, including any towed items. Rigs exceeding 24 feet must purchase in camping areas that allow longer rigs (see camping ticket pages and FAQs for details at peacelovevans.com/faqs).

Trailers: Towed vehicles and trailers are generally not permitted in standard van camping rows to ensure adequate spacing and emergency vehicle access. Exceptions must be approved in advance.

Vehicle Placement: All vehicle placement is at the sole discretion of PLV staff. Attendees must follow all parking and placement instructions. Moving vehicles without staff authorization is prohibited.

You acknowledge that all vehicles, camper vans, personal property, and belongings are brought to and stored at the Event entirely at your own risk.

We are not responsible for any loss, theft, or damage to vehicles or personal property, including but not limited to damage caused by other attendees, weather conditions, terrain, or third parties.

You assume full responsibility for securing and insuring your vehicle and belongings.

Generator Use: Generator use may be restricted to designated hours. Attendees must comply with all noise and generator policies posted on-site or in the event FAQ page (peacelovevans.com/faqs).

2.3 Compliance with Staff Directions

Attendee agrees to immediately comply with all instructions, signals, and directions given by PLV staff, security personnel, volunteers, property owners, and law enforcement. This includes, but is not limited to:

• Vehicle placement, parking, and movement instructions
• Fire safety compliance and burn ban adherence
• Evacuation and emergency procedures
• Noise restrictions and quiet hours
• Health and safety protocols
• Conduct and behavior expectations

Failure to comply with staff guidance constitutes a material breach of these Terms and is grounds for immediate ejection from the Event without refund.

2.4 Incorporation of Event Rules & FAQ

All rules, guidelines, Do’s and Don’ts, and site-specific policies listed on the official PLV FAQ page (peacelovevans.com/faqs) are hereby incorporated into these Terms by reference and constitute binding obligations on all Attendees.

It is the Attendee’s responsibility to review the FAQ prior to arrival and to abide by all rules listed therein. Ignorance of posted rules is not a defense to enforcement action.

2.5 Schedule Changes & Fire Restrictions

Programming Changes: PLV reserves the right to modify, reschedule, substitute, or cancel any scheduled activity, workshop, vendor, exhibitor, or entertainment for any reason, including but not limited to weather, safety concerns, vendor cancellation, or Force Majeure, without refund or compensation.

Fire Restrictions & Burn Bans: All fire-related activities are subject to local, county, and state fire restrictions and burn bans. In the event of a burn ban, all fires (including campfires, charcoal grills, and fire pits) must be immediately extinguished.

Attendees are personally and financially liable for all costs, damages, fines, and penalties resulting from unauthorized fires or failure to comply with burn bans, including but not limited to firefighting costs, property damage, and legal penalties.

2.6 Prohibited Items & Conduct

The following items and behaviors are strictly prohibited:

• Illegal drugs, controlled substances, and marijuana (even where otherwise legal)
• Fireworks, explosives, pyrotechnics, and flammable materials
• Weapons including firearms, knives with blades over 3 inches, brass knuckles, tasers, pepper spray, and any other weapons (regardless of permit or license status)
• Disruptive, threatening, violent, or unsafe behavior
• Harassment, discrimination, or hate speech of any kind
• Damage to property, vehicles, or natural resources
• Unauthorized vendor activity or commercial sales
• Violation of applicable federal, state, or local laws

Violation of these prohibitions will result in immediate ejection from the Event without refund and may result in criminal prosecution. PLV reserves the right to search bags and vehicles for prohibited items.

2.7 Minors & Supervision

Parental Responsibility:

Parents and legal guardians are solely and completely responsible for the supervision, safety, and conduct of minors (persons under 18 years of age) at all times during the Event.

No Childcare Services: PLV does not provide childcare, babysitting, or supervision services of any kind. Minors must be accompanied and supervised by a parent or legal guardian at all times.

High-Risk Areas: Children must be actively supervised near water, roads, vehicle traffic, parking areas, fire pits, poorly lit or unlit areas and during all activities. Parents are liable for any injuries to or caused by their children.

Waiver Execution: A parent or court-appointed legal guardian must execute all required waivers on behalf of any minor attendee.

2.8 Property Damage & Insurance

No Bailment: Attendee’s presence on the Property and parking of vehicles does not create a bailment or any duty of care for vehicles, camping equipment, or personal property.

Not Responsible for Damage or Theft: PLV is not responsible for any damage to, theft of, or loss of Attendee’s vehicle, camping equipment, personal property, or belongings, regardless of cause, including but not limited to: weather damage, theft, vandalism, fire, vehicle accidents, wildlife, or acts of other attendees.

Insurance Required: Attendee agrees to maintain adequate insurance coverage for their vehicle, property, health, and liability. Attendee acknowledges that PLV does not provide insurance coverage for attendees.

Attendee Liability: Attendee is financially responsible for any damage they cause to the Property, facilities, vehicles, or property of PLV or other attendees, whether caused intentionally, negligently, or accidentally, and including damage caused by Attendee’s guests, minor children, or pets. Attendee agrees to reimburse PLV or the affected party for the full cost of repair, replacement, cleanup, or remediation, and for any fines, penalties, or charges assessed against PLV by the property owner or any governmental authority as a result of Attendee’s actions or omissions. This obligation is in addition to, and not in limitation of, the fire-related liability described in Section 2.5.

2.9 Third-Party Vendors & Exhibitors

PLV is not responsible for the acts, omissions, products, services, or conduct of any third-party vendors, exhibitors, food trucks, sponsors, or independent contractors present at the Event.

All vendors and exhibitors are independent contractors and are solely responsible for their own actions. Any claims arising from vendor products, services, or conduct must be directed to the vendor, not PLV.

Attendee agrees to hold PLV harmless from any claims related to third-party vendors.

2.10 Photography, Media & Publicity Rights

By attending the Event, Attendee grants PLV  an irrevocable, perpetual, worldwide, royalty-free, transferable license to use Attendee’s name, image, voice, likeness, and participation in any and all media, including but not limited to photographs, videos, audio recordings, live streams, social media posts, and promotional materials.

Attendee waives any right to inspect or approve the finished product or any written copy that may be used in connection therewith. Attendee waives any right to royalties, compensation, or other payment related to the use of their image or likeness.

PLV may edit, alter, copy, exhibit, publish, or distribute images and recordings for any lawful purpose. Attendee acknowledges that they will not be compensated for such use.

2.11 Pet Policy

Pets may be allowed at the Event subject to posted rules and restrictions. All pets brought to the Event must be current on all vaccinations required by applicable state and local law, including rabies vaccination, and must be in good health and free of fleas, ticks, and communicable diseases. Attendee represents and warrants that their pet meets these requirements and agrees to provide proof of current rabies vaccination upon request by PLV, Event staff, or animal control authorities. Attendee acknowledges that pets, including their own and those of other attendees, may bite, scratch, or otherwise injure people or other animals. Attendee is solely responsible for any injury caused by their pet to any person, animal, or property, and agrees to immediately remove any pet that displays aggressive behavior. Attendee agrees to maintain control of their pet at all times and comply with all leash requirements. PLV is not responsible for injuries caused by other attendees’ pets, and Attendee agrees to indemnify PLV from any claims related to their pet, including claims arising from the pet’s health or vaccination status.

2.12 Force Majeure & Event Cancellation

Force Majeure Defined: “Force Majeure” means any event or circumstance beyond PLV’s reasonable control, including but not limited to: acts of God, natural disasters (hurricanes, floods, earthquakes, wildfires), pandemic or epidemic, government orders or restrictions, civil unrest, terrorism, war, strikes, utility failures, or any circumstance that makes Event operation impossible, impractical, illegal, or unsafe.

Right to Cancel or Modify: PLV reserves the right to cancel, postpone, relocate, or significantly modify the Event due to Force Majeure or safety concerns at any time, including after the Event has commenced.

Remedies for Cancellation: In the event of Event cancellation due to Force Majeure, PLV’s sole obligation shall be, at its discretion, to either: (a) offer a credit toward a future PLV event of equal or lesser value, or (b) refund the ticket price only.

No Other Damages: PLV shall not be liable for any other costs, expenses, damages, or losses, including but not limited to: travel expenses, accommodations, fuel, time off work, vehicle preparations, or any consequential, incidental, or special damages.

Partial Event: If the Event is partially completed before cancellation, refunds or credits may be prorated at PLV’s sole discretion.

2.13 SMS & Text Message Communication

By providing your mobile phone number to PLV, you consent to receive text messages (SMS/MMS) regarding event updates, safety alerts, schedule changes, and marketing communications.

Messages will originate from (941) 200-6899. Message frequency varies. Standard message and data rates may apply. Consent to receive text messages is not a condition of ticket purchase.

Opt-Out: You may opt out at any time by replying “STOP” to any text message. For help, reply “HELP” or contact hello@peacelovevans.com.

Mobile information will not be shared with third parties for their own marketing purposes. All other terms of this Privacy Policy apply.

2.14 Accessibility & Accommodations

PLV strives to provide reasonable accommodations for attendees with disabilities in accordance with applicable law. However, Attendee acknowledges that the Event takes place in remote, natural, outdoor environments with inherent accessibility limitations.

Attendees requiring accommodations should contact PLV at hello@peacelovevans.com at least 30 days prior to the Event to discuss available options.

2.15 Drones

Prohibition on Unauthorized Drone Use: The operation of drones, unmanned aerial vehicles (UAVs), or any remotely piloted aircraft on or over the Property is strictly prohibited without prior written authorization from PLV.

Authorized Operators: Authorized drone operators must comply with all applicable FAA regulations, hold required certifications and registrations, maintain adequate liability insurance, and execute a separate Drone Operator Agreement prior to any flight operations. Failure to comply will result in immediate revocation of authorization and ejection from the Event without refund.

Liability: Any authorized or unauthorized drone operator is solely liable for any injury, property damage, or loss caused by their drone. PLV is not responsible for damage caused by drone operations.

PART 3: LEGAL PROVISIONS

3.1 Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. 

Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms, the standalone Liability Waiver, or attendance at any PLV event shall be resolved exclusively by binding arbitration. Such arbitration shall be administered under the Commercial Arbitration Rules of the American Arbitration Association then in effect, before a single arbitrator with experience in Florida law. The arbitration shall be conducted in the the Florida county in which the Event was held, or in another location the parties agree to in writing. The arbitrator shall apply Florida law exclusively. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

No Class Actions: Attendee waives any right to bring or participate in any class action, collective action, or representative proceeding arising out of or related to these Terms or any PLV event.

Exceptions: Nothing in this Section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

3.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent, or if modification is not possible, such provision shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.

3.3 Entire Agreement & Amendments

These Terms constitute the entire agreement between Attendee and PLV regarding attendance at the Event and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
PLV reserves the right to modify these Terms at any time by posting updated Terms on the PLV website. Continued attendance at the Event after such modifications constitutes acceptance of the modified Terms.

3.4 No Waiver

The failure of PLV to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative of PLV.

3.5 Survival
The following provisions shall survive the conclusion of the Event and remain in full force and effect regardless of any termination or expiration of these Terms: Part 1 (Liability Waiver & Medical Release), Section 2.1 (Ticketing, Refunds & Cancellation), Section 2.8 (Property Damage & Insurance), Section 2.10 (Photography, Media & Publicity Rights), Section 3.1 (Governing Law & Dispute Resolution), Section 3.2 (Severability), Section 3.3 (Entire Agreement), and Part 4 (Privacy Policy).

PART 4: PRIVACY POLICY

4.1 Information We Collect

We collect the following categories of personal information:

• Identifiers: Name, email address, mailing address, phone number, IP address, and other similar identifiers.
• Commercial Information: Ticket purchase history, payment information (processed through third-party payment processors), and transaction records.
• Emergency Contact Information: Name and phone number of emergency contacts provided by Attendee.
• Health Information (Limited): Medical information provided voluntarily during first aid treatment or via liability waivers for emergency response purposes only.
• Internet Activity: Website browsing history, search history, and interaction with our website or advertisements (collected via cookies and analytics tools such as Google Analytics).

4.2 How We Use Your Information

We use your personal information for the following purposes:

• To process ticket purchases and fulfill orders
• To communicate event updates, schedule changes, and safety alerts
• To screen for fraud and ensure security
• To provide emergency medical response and contact emergency contacts
• To send marketing and promotional communications (with opt-out available)
• To respond to customer service inquiries
• To document incidents and defend against legal claims
• To improve our services and analyze website usage

4.3 Information Sharing & Third Parties

We share your personal information with third-party service providers only as necessary to provide our services. These third parties include:

• Payment processors (e.g., Stripe, PayPal) for transaction processing
• E-commerce platforms (e.g., WooCommerce, Shopify) for ticket sales and order management
• Email marketing services (e.g., Mailchimp) for newsletters and updates
• SMS/text message providers for event alerts
• Google LLC for waiver collection and data storage (Google Forms)
• Analytics providers (e.g., Google Analytics) for website usage analysis
• Insurance providers (for claims and incident documentation)
• Successors in interest, in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.

We do not sell your personal information to third parties for their own marketing purposes.

We may disclose your information when required by law, court order, or to protect the rights, property, or safety of PLV, our attendees, or others.

4.4 Sensitive Personal Information

We collect limited health and medical information provided voluntarily during first aid treatment or via liability waivers.
Purpose: This sensitive information is used solely for emergency response, incident documentation, and legal defense purposes.
